Refund and Return Policy

In accordance with the Belgian Economic Law Code and European legislation (Directive 2011/83/EU), the customer has a period of 14 calendar days to exercise their right of withdrawal, without having to provide a reason.

1. Legal right of withdrawal – 14 days

In accordance with the Belgian Economic Law Code and European legislation (Directive 2011/83/EU), the customer has a period of 14 calendar days to exercise their right of withdrawal, without having to provide a reason.

The time limit begins to run:

  • from the day after the package is received by the customer or a designated third party,
  • or from the date of receipt of the last item in the case of multiple orders.

After this period, no return requests will be accepted.

2. Procedure for exercising a return

All return procedures must follow these steps:

  1. The customer must notify their return request to the following address:
    info@biya-modesty.com
    by mentioning:
    • first and last name,
    • the order number,
    • the reference numbers of the articles concerned.
  2. No order should be returned without prior confirmation from our customer service department.
  3. After Biya Modesty has approved the request, the customer has a maximum of 14 days to return the items.

Any shipment not preceded by an official request by email may be refused.

3. Conditions for accepting a return

Returned items must meet all of the following conditions:

3.1. General condition of the item

Items must be in perfect condition and meet the following criteria:

  • Item not worn (testing permitted indoors only).
  • Item not washed.
  • Item free of stains, odors, traces of makeup, perfume, perspiration, or cigarette smoke.
  • Item free of stains, odors, traces of makeup, perfume, perspiration, or cigarette smoke.
  • Item free of hair, dust, traces of body lotions, or styling products.
  • Item in exactly the same condition as when received.

3.2. Labels and markings

Labels must be present, attached, and intact.
An item whose label has been removed, cut, or torn off cannot be returned.

3.3. Original packaging

Items must be returned within:

  • their original packaging, when intact,
  • or in equivalent packaging that provides sufficient protection to prevent damage during transport.

Damaged or insufficient packaging may result in the return being refused.

4. Non-returnable items

For hygiene reasons and in accordance with regulations, the following items cannot be returned:

  • Underwear and lingerie,
  • Swimsuits from which sanitary protection has been removed,
  • Headwear accessories such as hats, turbans, scarves, and hijabs already tried on,
  • Items customized or modified at the customer's request,
  • Items showing obvious signs of use.

5. Return shipping costs

Return shipping costs are entirely the responsibility of the customer.
Biya Modesty does not provide return labels and does not refund initial shipping costs, except in cases of error attributable to the store (e.g., incorrect item received).

The customer is responsible for:

  • the choice of carrier,
  • payment of shipping costs,
  • the correct packaging of the parcel,
  • keeping proof of deposit or a tracking number.

In the absence of proof of shipment or in the event of loss of the package by the carrier, no refund will be made.

6. Inspection and validation of the return

Upon receipt of the returned package:

  1. A comprehensive quality control check is performed.
  2. Biya Modesty reserves the right to refuse any return that does not comply with the conditions set out above.
  3. If the item has decreased in value due to improper handling, a partial refund may be applied in accordance with Belgian law.

Refused returns may be sent back to the customer at their expense.

7. Refunds

When the return is approved:

  • The refund will be made using the same payment method used for the purchase.
  • within a maximum period of 14 days following receipt and acceptance of the return.

No refunds will be issued until the items have been physically received and inspected.

Initial shipping costs are not refunded, except in the case of a preparation error or proven defect.

8. Exchanges

Exchanges are only possible in the following cases:

  • article défectueux à la réception,
  • item incorrect in relation to the original order.

In these specific cases, Biya Modesty will cover the cost of returning the defective or incorrect item.

For all other requests, a standard return must be made and a new order placed.

9. Promotional items

Sale items or promotional items may be returned, unless explicitly stated otherwise on the product page.
They are subject to the same return conditions as standard-priced items.

10. Products received as gifts

If the item was registered as a gift at the time of purchase:

  • a credit note may be issued in the name of the recipient,
  • or the refund will be made to the original purchaser according to the payment method used.
